Police Charge 46 Alleged Gay To Court

The State Criminal Intelligence and Investigation Department of the Police in Panti-Yaba, Lagos has instituted charges against forty six men alleged to be engaging in homosexual activities before a Federal High Court.

However, the the police could not arraigned arraign the suspects due to lack of space in court.

The presiding judge, Justice Rilwan Aikawa who presided over the court observed that the courtroom was too small to accommodate all the defendants.

He adjourned the arraignment till November 22, when a bigger courtroom would have been found.

The defendants are part of the fifty seven persons arrested at a hotel in Egbeda on twenty fifth of August last year by State Police Command.

The police alleged that the suspects were picked up at about 2am while they were performing gay initiation rites for newly recruited members.

The defendants had pleaded not guilty to a three-count charge of conspiracy, membership of a secret cult, and unlawful gathering when they were arraigned at a Yaba Chief Magistrates’ Court.

Chief Magistrate Kikelomo Ayeye admitted each defendant to bail in the sum of two hundred thousand naira with one surety in the like sum.

But the police re-filed a one-count charge against the defendants at the higher court for lack of jurisdiction.

When the matter was called, defense counsel, Israel Usman informed the court that 46 out of 57 of the defendants were in court set for arraignment.

But Justice Aikawa observed that only 36 names were listed before him as defendants.

The judge added that since the defendants were all on administrative bail, rescheduling the arraignment would not be unfair to them.

He advised prosecuting counsel Joseph Eboseremen to serve all necessary documents on the defense to enable them file all necessary applications on the adjourned date.

According to the new charge marked FHC/1/311c/19, the defendants made “public show of a same sex amorous relationship with each other in hidden places within Kelly Hotel” Egbeda.

The police said the defendants actions contravened Section 5(2) of the same sex marriage (prohibition) Act, 2013.

“The defendants are: Segun Ode, Afolabi David, Azeez Tunde, Adedokun Pelumi, Smart Joel, Iyodun Ehiosun, Rilwan Jamiu, Raphael Matthew, Friday John, Godswill Kola, Chibuike Emmanuel, Prince Collins, Daniel Aya, Edeh Amarachi, Alozie Innocent, Kelvin Nwachukwu, Okekoya Gbemi, Odika Emmanuel, Kufo Emmanuel, Adewole Micheal, Kunle Samson, Daniel Soka, Alabi Olamilekan, Oluwaseun Odu, Oladipo Eniola , Bobby Moses, Desmond Onuha, Joseph Victor, Omoniyi Tobi, Kelvin Abuchi, Mohammed Abubakar, Lawal Yusuf, Odusina Micheal, Wole Ojo, Remy Godwin, Abiombola Damilola, Laguda Olamilekan, Alhassan Opeyemi, Samson Ode, Musibau Remi, Ibrahim Yusuf, Olajide Olaide, Isaac Patrick, Wasiu Ajibade, Oguaghanba Onyeka Miracle, Okechukwu Noble, Balogun Olanyinka, Abioye Wealth Olasunkanmi, Isa Asoma, Rasheed GBenga, Obiafor James, Jesse Paul, Oladipo Femi, Ogunirinde Yusuf, Chris Godsent, Solomon Showole, Olawale Adebayo and others at large.
