
A victim of the alleged collision of Lagos Bus Rapid Transit (BRT) with a moving train, Oluwajani Fayokemi, recounted her ordeal before a Lagos State High Court in Ikeja.
She testified how she was thrown to the side of the road when the BRT crashed into the train and also told the court that she was lucky to be alive, as the other occupants of the vehicle were not so lucky.
The accident caused extensive damage to the BRT and the train.
She testified that Osibanjo was always careful and drove with caution. She also said that he was always on time and never exceeded the speed limit. She described him as a safe and professional driver.
Asked by the prosecution counsel how many people were taken to LASUTH, the witness responded that she did not recall the number.

Asked if she recalled her police statement after she regained consciousness, the witness replied that the incident was still fresh in her mind.
Egberongbe then asked her to point out her statement to the police, where she said that passengers heard the honk of a coming train and called out to the driver.
The witness said that the aspects were not recorded in her written statement.
The defence counsel asked where she was sitting on the bus, and she said she sat in the middle – second door on the first seat.
The counsel then said that the driver should have been mostly affected considering that he sat in front, but the prosecuting counsel objected.

Justice Oyindamola Ogala adjourned the matter to Nov 8.
On May 2, Ogala remanded the defendant to the Kirikiri custodial facility after arraignment.
Osibanjo pleaded not guilty to a 16-count charge of involuntary manslaughter brought against him by the Lagos State Government.
The defendant’s alleged offences border on running into a moving train, causing grievous harm and involuntary manslaughter.
The alleged offences contravene the provisions of Sections 244 and 245 of the Criminal Law of Lagos State, 2015.
