Phone Theft: FCMB Account Holder Secures Conviction Against Fraudster

A Federal High Court in Uyo, Akwa Ibom State, has convicted a Fraudster, Henry Asuquo for fraudulently withdraw of N700,000 from FCMB bank account of a Petitioner by swapping her phone SIM card.

The presiding judge, Justice Agatha Okeke, however reserved sentencing till March 23 while ordering him to be remanded in correctional facility.

The convict was arraigned on a two-count charge of impersonation, cybercrime and fraud by the Economic and Financial Crimes Commission, EFCC.

Henry Asuquo, who had been parading himself as a soldier to defraud people, was arrested by the anti-craft agency following a petition from a victim whom he fraudulently withdrew from her FCMB bank account by swapping her phone SIM card.

He initially pleaded not guilty when he was first arraigned and later change his plea to guilty when the matter is ongoing the development which led to his conviction.

His lawyer, Dennis Adiaka, had informed the court of his client’s intention to change his plea.

Adiaka noted that as a form of regret, the convict has restitute N100k to the victims FCMB Account.

During trial, EFCC had through his counsel, Adebayo Soars, tendered
Army uniforms, boots and bullet proof jackets, recovered from Mr Asuquo’s house, before the court as exhibits.

The prosecution lawyer presented two witnesses and a letter from the Nigeria Army to the court during the trial.

Justice Agatha Okeke, in her judgement, ruled that the evidence of the prosecution witnesses proved the ingredients of the offences in the charges.

She, therefore, convicted Mr Asuquo on both counts and ordered his remand at the state correctional facility until March 23 when he would be sentenced
