Court Dismisses Dr. John Abebe’s No-Case Submission in N120m Fraud Trial, Orders Defence to Open May 28

A Lagos State Special Offences Court has dismissed a no-case submission filed by Dr. John Abebe and the third defendant, Inducon Nig. Ltd over alleged N120 million fraud.

The defendants, with one Kamoru Oladimeji (second defendant), are standing trial on a six-count charge bordering on conspiracy to steal, stealing, conspiracy to obtain by false pretence, obtaining by false pretence, and obtaining execution of security by false pretence.

Justice Olubunmi Abike-Fadipe, while delivering a ruling on a no-case submission, held that the prosecution had presented sufficient evidence to require the defendant and his company to enter their defence.

Fadipe held that at the stage of a no-case submission, the court only determined whether the prosecution had produced legally admissible evidence linking the defendants to the offences charged and not whether the evidence was sufficient for conviction.

The judge ruled that evidence led by the prosecution indicated that the defendants allegedly obtained about N120 million from the complainant’s company, Arsenal Technologies Ltd, by pledging property as security which had earlier been pledged to a bank.

Fadipe said the evidence, if believed, required an explanation from the defendants, and consequently dismissed the no-case submission and ordered them to enter their defence.

The defendants were arraigned by th Economic and Financial Crimes Commission (EFCC) on Sept.19, 2022.

During the trial which commenced in 2022, EFCC Counsel, Mr Suleiman Suleiman, had called four witnesses and closed its case on May 15, 2025.

The defendants, through their counsel, had subsequently filed a no-case submission on Oct.14, 2025 and argued that the prosecution failed to establish a prima facie case linking them to the alleged offences.

EFCC, in one of the counts, alleged that the defendants on June 4 2013 in Lagos, conspired amongst themselves to commit felony to wit; stealing the sum of N120 million worth of property of Arsenal Technologies Ltd.

The anti-graft agency also submitted that the defendants obtained by false pretence the sum of N120 million property of the company, under the pretence that the defendants’ property lying being and situate at 9, Magbon Close, Ikoyi which they pledged as the security to the company was unencumbered, a representation they knew to be false.

According to the prosecution, the alleged offences contravene Sections 314, 287 of the Criminal Law of Lagos State 2015 and the Advance Fee Fraud and Other Fraud Related Offences Act 2006.

The case was adjourned until May 28 for for defendants to open their defence.
